image harvesting warning

Another magazine, another competition, another set of completely shonky
terms and conditions -

Sad to see image harvesting is still alive and well.  If any one has
students who may stumble across this little scam, please warn them not to
participate !  It's all very well to give away a camera for a winning photo
but to own the license of *every* submitted image is a bit rich! They could
probably run their magazine for a year or more without having to pay a cent
for any of the images they use, and if the magazine isn't performing well
the owners are nicely set to sell off their image base to make a few dollars

the offer:
"we are also giving away a stunning Leica camera kit valued at $2000 ..To
enter the competition to win the camera gear, you just need to send us your
best adventure-themed photograph.."

the terms:

"4. All entries shall become the property of the Promoter and no information
as to the quantity of entries shall be provided to Participants.  Entries,
including photographs, will not be returned to Participants. Entry details
(includirg any photograph) may be used for future promotional, marketing
marketting and publicity purposes.

5. Entries must be the original independent creation of the Participant and
free of any claims, including copyright or other intelectual claims, by
other parties.  Entries must not have been published previously, used in any
competitions or infrings any third party rights.

6. By submitting an entry Participants grant the Promoter a perpetual,
irrevocable, non­-exclusive, royalty free, worldwide license to do the
following in respect of the entry:

(a) use, reproduce, publish, adapt edit, publicly perform, broadcast,
transmit or communicate to the public; and
(b) sublicense the rights granted in paragraph (a) above to any third party;

and Participants will not be entitled to any fee for such use."

Unbelievable that people would fall for entering any of their photos under
these conditions.

Why not, most people that would send in their snaps for these dort of comps
would not care at all it is only the people that strive to be better than
happy snappers that would care.

I've got more chance of winning a nice camera than making any money from
my photos.
I'd get a huge kick out seeing my photos used commercially and not being
a professional photographer the rights aren't that important to me.
