A little birdie from Down Under just e-mailed me telling me that
Douglas has finally posted some of his pics for us, including the two
test shots from his 20D - FZ50 test.

http://www.pbase.com/photosbydouglas

So I guess I'll have to eat a piece of Humble Pie and commend D-Mac
for finally sharing some of his work.
Way to sack up, mate!

I must say that I do feel sorry for the poor family that he photographed,
hope he gave them a refund. They would have to be close to the worst family
portraits I have ever seen.

Open letter to PBase:

Recently Bret Hogan, also known as Bret Douglas a client of yours,(
http://www.pbase.com/bret/profile ) illegally downloaded, modified and re
posted images of mine using my name in gallery. The link he subsequently
posted to newsgroups is: http://www.pbase.com/photosbydouglas

I am Douglas MacDonald, A Professional Photographer operating from Brisbane
Australia. The images were lifted without my authority, despite clearly
marked notices they are copyright image ...from my web site:
http://www.photosbydouglas.com

His actions are in violation of Australian and US Copyright law. If you
continue to host these photographs. I will instruct my lawyers to commence
legal action against PBase and Hogan under International copyright laws.

I hope such action will not be necessary and you will take action to satisfy
my complaint. I await your urgent attention.

Yes I'd be worried about such damning evidence too, and yet you still have
other details on your web site showing your misunderstanding of photographic
issues?
Why did you bother at all, when you have proven nothing except your
inability to conduct a proper comparison?

So you didn't open that account? Are those not your photos?
I'm a little confused.
It says "Douglas MacDonald" right there on the web gallery.
Isn't that you, D-Mac?  Surely no other self-respecting photographer
would claim those awful pics.
Is it possuble under Australian law to sue yourself?
How about to f.ck yourself?

Your time is coming Bret. Watch the mail box.

I really didn't think you'd stoop to stealing someone else's images as
retaliation for not getting your way. Pretty childish stuff mate. Wait until
you hear what PBase has to say about the IP address from where the site was
set up...

It would seem, based on your theft of my gallery, probably all the images
you claimed were yours are more than likely stolen from someone else too.
What a swine you really are. Wasting our oxygen too.

You must suck at poker, as well.

I kinda doubt that pbase tracks IP addresses.  However, they do
require an e-mail address so maybe you should check out whose e-mail
address the site is linked to.

Assuming you didn't set up that site yourself, whoever did must be
having a good laugh at your expense right now.  After seeing your
horrid photos once again, I know I am.  "Bridezilla!"  LOL!

She's terrifying! Almost as scary as the one-legged groom.

That PBase galley is gold. Thanks for the heads-up.

Great work, Douglas.

PBase would NEVER give you the IP address of anyone who set up a site like
that unless presented with a court order.
And I see you admit that the photos on the PBase gallery are in fact yours,
Admitting there is a problem is the first step in getting help, and lets
face it, you need help.
Now calling someone a thief, even on Usenet is likely going to see a couple
of letters arriving in YOUR P.O. Box, especially considering that you,
weather you like it or not, are a publicly traceable identity. Lets face it,
you have your contact details plastered all over your web site.
As to who the real Oxygen thief is, I will leave that up to the readers
judgment.

Yeah look at the expression on the older woman, look at the lighting on the
man's face, look at the lousy setting and cropping.
Not what I'd post on a web site, even if the girls are cute :-)

Kid:  "OK if I just put my leg up here like this?"
D-Mac:  "Sure kid, no worries."

Perhaps D-Mac is used to posing kids wearing shorts that way?

All the images were your unaltered originals, weren't they?

No one else claimed them. (or would want to)

Pbase'd in your name.

Where was this copyright infringement?
Mr.T - 15 Feb 2007 07:39 GMT
..

In the fact that they were posted without the permission of the copyright
holder. How it was done is irrelevant.

(But Dmac not wanting people to see photo's *HE* originally posted for
people to see, is funny none the less :-)

I find that point extremely funny.  It would appear that, to Douglas, if
someone else puts something on the web it is fair game for him to copy
and post.  If he posts something on the web, he's upset if people look
at them, let alone mirror them onto pbase to save him some of his
precious bandwidth!

I was curious if they were removed for this reason rather than outright
embarresment.... woul dnot quite be his style to be embarressed though

Of course they were removed because D-Mac was embarrassed for anyone
to see them.  What other possible reason could there be?
I don't see why he was so upset with the pbase site.  It was just free
pub for him and his pics.  He got more exposure in 3 days than his own
site did all year.  And he didn't have to worry about those troubling
bandwidth limitations that his cheapo provider limits him with. One
would think that with D-Mac's supposed wealth, he could afford a
decent web provider.

All his phony bluster about "identity theft" and "copyright
infringement" is a load of hooey.  The images were clearly labeled
with his name and nobody profited by the enterprise that I can tell.
The only folks benefitting from the site were the people who clicked
on the links and read all the funny comments.  They were rewarded with
laughter so severe as to cause snot bubbles to come out. Almost as
funny are his current threats to involve the FBI, the NSA, James Bond,
ASIS, MI6, Interpol and Mossad on the case.

"Don't sweat the terrorists, boys, there's a guy on a boat getting
laughed at that we must deal with urgently!"

Which does NOT make any difference. It IS still a copyright infringement.
What it does affect is his abilty to claim damages in court. I sure hope he
is not expecting to cover his legal costs :-)

Yes, it is good for a laugh at least. :-)
